2.1.1.                       Access to this website is granted by SiteSource, subject to the conditions laid out in this document. If you don not agree with any of these terms you should stop using this service.

2.2.2.                       SiteSource does not warrant that this site, it’s servers or e-mail sent from sitesource.com.au are free of viruses or other harmful components. SiteSource will not be held liable for any kind of damages of any kind arising from any use of this website including, but not limited to, direct, indirect, incidental, punitive, special and consequential damages.

2.4.           Unlawful or Prohibited Use

2.4.1.                       It is a condition of provision of any or all services on this website that you use them in a lawful manner. You may not use these services to damage, disable, overburden or impair the computer servers or interfere with any other parties use of the website.

3.     Hardware Sales

3.1.1.                       This sale agreement is a legal contract between the Customer and SiteSource. By making a purchase, placing an order or otherwise shopping on this site, the Customer agrees and accepts this agreement.

3.1.2.                       This agreement constitutes the entire agreement in relation to the sale. This agreement can only be terminated or modified by written advice from SiteSource.

3.2.           Title

3.2.1.                       Title of goods passes to the purchaser upon delivery and receipt of payment.

3.3.           Disclaimer

3.3.1.                       SiteSource expressly disclaims all warranties either expressed or implied, including, without limitation, any warranty or merchantability or fitness for a particular purpose. All products sold by SiteSource are produced by third parties and are subject to warranties and representations of applicable manufacturers. All prices are subject to change without notice. SiteSource reserves the right to make changes to prices based on market conditions, manufacturer price changes or errors, general advertising or marketing errors, including typographical errors on the website. If SiteSource requests payment of higher prices, the customer may cancel the order at any time prior to the day of delivery. While SiteSource makes every effort to display current information on the website, we make no warranty or representation as to it’s accuracy.

3.3.2.                       SiteSource does not warrant the information, including any pictures or specifications, describing the products on its website, is current or correct. In all cases the customer must check with the manufacturer to determine the accuracy of this information.

3.3.3.                       SiteSource will not be held liable for any lost profit, loss of business or any other damages, even if advised of such possibility. SiteSource will not be held liable for loss of data or product functionality or availability. Liability for any failure of the product during it’s 30 day warranty period will be limited to the replacement cost of the product either financially or in kind, at SiteSource’s absolute discretion.

3.3.4.                       No contract will come into existence until the customer’s order has been accepted by SiteSource. Terms of payment are within SiteSource’s absolute discretion. Terms are strictly cash on or before delivery, and cheques are only accepted by express prior arrangement. Title of the goods or services does not pass to the customer unless payment is received in full. We reserve the right to collect the goods if full payment is not received.

3.4.           Returns Policy

3.4.1.                       SiteSource complies with New South Wales Fair Trading Laws regarding warranting the products we sell. If there is an original manufacturing fault with a customer’s purchase, the products  may be returned to SiteSource for replacement or refund, at SiteSource’s sole discretion. Prior to returning a product to SiteSource the customer must contact us at contactus@sitesource.com.au to organise a returns authorisation. SiteSource may at it’s sole discretion reject any returns delivered without this authorisation.

3.4.2.                       Many manufactures warrant their products beyond the requirements of NSW law. In cases where the original manufacture’s warranty offer is beyond that required by law, the customer must deal directly with the original equipment manufacturer or distributor to attain benefit form this agreement.

3.5.           Delivery

3.5.1.                       Unless otherwise advised customers will be required to pay all delivery charges, taxes and duties. SiteSource may at it’s own discretion deliver in instalments, in any sequence for all products ordered. Full payment is required on or before the delivery of the first instalment. Any dates quoted for delivery are approximate and SiteSource shall not be held liable for any delay in delivery.

3.5.2.                       Unless the customer expressly notifies SiteSource to the contrary, within two days of delivery, the products will be deemed to have been delivered correctly, in working order and without defect.

3.5.3.                       If the is no one available to take delivery at the specified location, when the SiteSource delivery agent arrives, SiteSource reserves the right to charge an additional fee. This additional fee amount may be up to and including the full price of the goods.

3.6.           Licences

3.6.1.                       The customer agrees to be bound by any third party licenses for the operation of their product. It is the manufacture’s responsibility to draw the customer’s attention to these terms and conditions, if present, and not that of SiteSource.

4.     Local ISP

4.1.1.                       SiteSource acts as a reseller for Internet access & ISP services. SiteSource expressly disclaims all warranties either expressed or implied, including, without limitation, any warranty of continuation of service or quality of service, from our service provider.

4.1.2.                       By filling in an application for an Internet access plan, Domain Registration, Online Marketing or E-Commerce plan the customer agrees to be bound by these SiteSource terms, the terms of the plan and the terms of our service provider.

4.1.3.                       The contract that is entered into with regard to the provision of the applicable service is directly between the customer and the service provider. SiteSource does not warrant the competency of the service provider or the service provider’s ability to provide the described service.

4.2.           Payment

4.2.1.                       As the Internet access contract is between the customer and service provider, all payment must be made directly to the service provider. SiteSource is not responsible for any payments sent to SiteSource for forwarding to the service provider.

4.3.           Acceptable Use

4.3.1.                       The customer agrees to be bound by the acceptable use policy of the service provider. The service provider should make their terms and conditions available to the customer, prior to payment for services and at a point prior to the completion of the contract.

5.     International Suppliers

5.1.1.                       SiteSource acts as a  reseller foreign based Hosting, Domain Registration, E-Commerce and Online marketing service providers. SiteSource expressly disclaims all warranties either expressed or implied, including, without limitation, any warranty of continuation of service or quality of service, from our service provider.

5.1.2.                       By filling in an application for an Internet access plan, Domain Registration, Online Marketing or E-Commerce plan the customer agrees to be bound by these SiteSource terms, the terms of the plan and the terms of our service provider.

5.1.3.                       The contract that is entered into with regard to the provision of the applicable service is directly between the customer and the service provider. SiteSource does not warrant the competency of the service provider or the service provider’s ability to provide the described service.

5.2.           Payment

5.2.1.                       As the Internet access contract is between the customer and service provider, all payment must be made directly to the service provider. SiteSource is not responsible for any payments sent to SiteSource for forwarding to the service provider.

5.2.2.                       In all cases of International supply, the laws governing the transaction will be the laws in the country as specified by the service provider. SiteSource does not warrant that the service provider will charge the applicable duties or taxes for such services, if imported into Australia. The customer acknowledges their responsibility to pay these charges, where applicable, and admonishes SiteSource of any and all responsibilities in relationship to these charges.

5.3.           Acceptable Use

5.3.1.                       The customer agrees to be bound by the acceptable use policy of the service provider. The service provider should make their terms and conditions available to the customer, prior to payment for services and at a point prior to the completion of the contract.

6.     Domestic Supply
